Longtime Donald Trump ally, childhood friend from New York Military Academy, and prominent Florida attorney Peter Ticktin sat down with The Gateway Pundit
to deliver a stark warning about what Americans can expect the moment radical Democrats seize control of the House and Senate on January 3, 2027.
Ticktin, who just scored a major courtroom victory last week when a Florida federal judge tossed former Dominion executive Eric Coomer's defamation lawsuit against Patrick Byrne, outlined three scenarios for the just-concluded 2026 midterms and laid out what he says is the Democrats' real plan if they take both chambers by a meaningful margin.
As The Gateway Pundit previously reported, U.S. District Judge Tom Barber granted summary judgment for Byrne after ruling that Coomer failed to prove actual malice by clear and convincing evidence, the standard required under Colorado law even for a non-public figure when the statements concern a matter of public concern.
Patrick Byrne publicly thanked Ticktin and co-counsel Stefanie Lambert for the win. Coomer still has a separate, long-delayed defamation case pending in Colorado against The Gateway Pundit, Jim Hoft, President Trump, and others.
The Three Possibilities – And Why Only One Leads to Immediate Impeachment
Ticktin told The Gateway Pundit there are three realistic outcomes from the midterms:
- Republicans hold both the House and Senate.
- Republicans lose the House, the Senate, or both, but only by thin margins.
- Democrats take the House and also seize the Senate by a substantial margin—roughly 8 to 10 seats or more.
Only the third scenario, Ticktin said, gives Democrats the numbers they need. "They need that in order to remove the president and the vice president when they impeach them. And this is what their plan is."
According to Ticktin, the timeline is already set. Roughly 62–63 days after the election, the new Congress is sworn in. "First thing they do in the House is elect their speaker. And then the next thing they get down to business on is impeaching both Donald Trump and J.D. Vance. And they don't need any real reason. They just need the votes. They just need a majority. … They can impeach them for pushing Humpty Dumpty off the wall."
In the Senate, removal requires 67 votes. Ticktin believes Democrats will not need to flip every vulnerable Republican. He pointed to RINOs, compromised members, and possible leverage involving past trips to Beijing, Ukraine, or other pressure points. "We know they have people that are RINOs and hate Donald Trump, and they're hiding it. But we know that they can probably get an additional 6 or 7 or 8 votes if they need them."
Manufactured Charges: "Murder" and "War Crimes"
Ticktin said the articles of impeachment are already being previewed. One line of attack involves the death of Renee Goode—an accusation Ticktin dismissed as "ridiculous" and "insane." A more serious (in their telling) charge centers on alleged "war crimes" related to Iran.
"They're going to blame him for Iran," Ticktin said. "This is what's so dangerous." He warned that after removal, Democrats would stage a televised trial featuring images of children killed in Iran in an effort to turn the world against Trump—echoing the Watergate spectacle. "Everybody's going to watch it. … And then he's going to be tried for these crimes after he's removed from office."
Ticktin was blunt about the endgame if Trump does nothing: "If he doesn't, they're going to hang him. They're going to kill him."
Machines, Caravans, and "Indicia of Fraud"
Ticktin rejected the narrative that voters simply turned against Trump over gas prices or foreign policy. "It's none of that. It's the machines. I think this was not the people that were speaking. This is the people that run the machines that were speaking."
He pointed to continued use of the same systems that operated in 2020, citing Brazil and other examples as evidence the infrastructure remains in place. "We know that they were operating in 2020, so it's not like they don't exist and never existed. … At this point we've got the evidence of it."
As further "indicia of fraud," Ticktin noted reports of a caravan moving through Mexico. Under a continuing Trump presidency, such a group has no realistic path across the border. The only scenario in which the caravan succeeds, he argued, is regime change.
The Gateway Pundit has previously covered Ticktin's allegations that experts examining Dominion machines in Michigan found "[phone] chips mounted on the motherboards," raising questions about remote connectivity.
Ticktin has also represented Tina Peters, pursued civil litigation on behalf of January 6 defendants, and publicly called for aggressive investigations into election interference, including against figures such as Eric Coomer and Colorado Secretary of State Jena Griswold.
Texas Numbers and Soft Republicans
Ticktin's comments came amid Gateway Pundit reporting on the astonishing vote totals for far-left Texas Democrat James Talarico, who defeated Ken Paxton. As The Gateway Pundit detailed, Talarico received more votes than Kamala Harris in 2024 and more than any Democratic statewide candidate in Texas since 2016—despite being a polarizing figure who has taken positions against oil, meat, and traditional Texas priorities.
Ticktin's response was direct: "Because it happens by the machines doing it."
He also criticized Senate Republicans for failing to pass the SAVE Act and clean up voter rolls. "John Thune should have had this SAVE Act pushed through. … He sold out the nation."
The Only Remaining Option
Ticktin told The Gateway Pundit that Trump currently believes he is safe because Democrats lack 67 votes. Ticktin disagrees. "Donald Trump himself doesn't—he sees it, he says, oh, they don't have 67 in the Senate. So therefore I'm still safe. I'm still the president, but he's not going to be for long."
The only path Ticktin sees to preserve the country is an executive order canceling the election results combined with martial law. "The only thing that Donald Trump can do is he's gonna have to come out with an executive order that basically says that the election is canceled. It's gonna have to be martial law. There's no other way that he can save the country at this point."
He noted that some observers, including Natalie Winters, have already reported that powerful interests are predicting exactly this response and preparing for street violence. Democrats, Ticktin added, have also signaled they will not allow post-election investigations—language he views as an admission.
"There's only one thing that can help… only one thing that can change it, and that would be what they're all saying. There'll be people in the streets if he does. But that's what he has to do. That's the only chance that we have at this point."
Ticktin compared the situation to Abraham Lincoln facing an impossible crisis. History later judged Lincoln favorably for the hard decisions; contemporaries hated him for them. "He's got to do it. It's the only thing that can help. It's the only way to save the country."
If Democrats succeed in removing Trump and installing their own administration, Ticktin warned, "we'll never see liberty again."
Peter Ticktin has spent years warning about election systems, representing targets of what he describes as lawfare, and calling for accountability. His latest assessment is the most direct yet: the window for ordinary political remedies has closed, and only decisive presidential action stands between the country and what he believes will be the permanent loss of constitutional government.
