Cop who pulled gun on co-worker for heating up fish in office microwave to hang up badge for life as he pleads guilty to disorderly conduct

A cop who pulled a gun on his co-worker for heating up fish in the office microwave was released on probation last month, on the condition that he surrender his police badge and never seek reinstatement.

Michael DeBiase, 46, has been sentenced to 90 days of probation, fined $350 and ordered to surrender his South Carolina Criminal Justice Academy police certification permanently, according to court documents obtained by The Smoking Gun.

Last May, a Myrtle Beach Police Department officer was amidst committing the famously dishonorable act of reheating fish in the break room microwave when former detective DeBiase pulled out his gun and pointed it at the odiferous offender.

DeBiase was arrested on June 2, two days after the encounter, and charged with presenting and pointing a firearm at a person, according to an arrest affidavit obtained by The Smoking Gun.

The pointing of the gun was part of DeBiase's confronting of his colleague for 'warming up fish in the microwave, causing an odor in the office.'

'The alleged incident involved DeBiase removing his department-issued firearm from its holster while in the PD briefing room,' MBPD wrote in a press release at the time of the arrest.

Officials said the detective was immediately placed on administrative leave following the incident.

DeBiase was booked into the J Reuben Long Detention Center in Horry County following his arrest.

DeBiase's bond was set at $5,000, and was posted by his wife Astrid DeBiase on June 12, ten days after the arrest, according to Horry County court records.

On October 23, the court ruled that DeBiase qualifies for a conditional discharge, given that he hasn't previously been convicted of any similar offenses in the past, court records showed.

If he violates the terms of his conditional discharge, the judge has the power to enter the offense on his official record as a conviction.
