Three state attorneys general (AGs) have subpoenaed Dr. Anthony Fauci as part of a joint investigation into his handling of the COVID-19 pandemic.

Florida Attorney General James Uthmeier issued an investigative subpoena to Fauci on Wednesday as part of a joint probe launched with Louisiana Attorney General Liz Murrill and West Virginia Attorney General John McCuskey.

"Just about an hour or two ago we issued a formal subpoena to Dr. Fauci under Florida state law seeking a breadth of documents ranging to what he knew, when he knew it, his doubts about the safety and efficacy of vaccines that he's out there promoting," Uthmeier said in an appearance on Fox News on Wednesday.

The three state attorneys general say that evidence points to self-dealing by Fauci, arguing that he sought personal gain from his pandemic leadership through book deals, financial awards, research grants and other professional opportunities.

 

"This is wrong and it could go towards a deceptive trade practice, fraud, public nuisance, you name it," said Uthmeier. "I think there's many aspects of Florida law that now are implicated."

"When somebody like Dr. Fauci is lying and deceiving the American people, pushing out directives and mandates that he privately questions as unsafe, and he's deriving a profit from it, that raises larger legal questions," Uthmeier remarked.

The claims rely on evidential records including Dr. Fauci's personal diary — retrieved by the Department of Health and Human Services (HHS) and published by Sen. Rand Paul (R-Ky.) — as well as internal emails previously obtained by The Washington Post through Freedom of Information Act (FOIA) requests.

 

Uthmeier cited emails in which he instructed subordinates to apply for awards on his behalf, eventually winning the Dan David Foundation prize that gained him $900,000 — earnings independent from his government salary.

In a joint news statement, he added, "Fauci's diary focused more on self-promotion than the legitimate safety concerns from the mRNA vaccines. While Fauci was pushing for book deals, awards, and fortune and fame, Floridians were being deceived and harmed by his misrepresentations."

 

McCuskey decried Dr. Fauci's 111 Fifth Amendment invocations at a recent Senate hearing, pointing out that a preemptive pardon from former President Joe Biden had already shielded him from prosecution prior to President Trump retaking office.

"Dr. Fauci's recent refusal to answer Congress's questions about his actions during the pandemic is concerning," stated McCuskey. "The American people deserve to know if they or their elected leaders were misled or manipulated. Both my Office and I support Attorney General Uthmeier's efforts to uncover the truth."

"The public deserves answers to about a million questions related to the pandemic, its origins, and the government's actions in response," Murrill chimed in. "What we know already is Fauci lied — we just don't know yet how much. But he lied about something as basic as keeping a diary. The truth will come out."

 

The documents sought by the three attorneys general include:

  • Awards applied for or received from any organization in Florida related to the COVID-19 pandemic;
  • The National Institute of Allergy and Infectious Diseases' (NIAID) research grant in 2022 to the University of Florida Scripps Biomedical Research program to address COVID-19;
  • The 2021 Dan David Foundation award;
  • Professional opportunities such as named professorships, book deals and memoir contracts, literary agents and board positions, that were pursued or considered;
  • Efforts seeking financial incentives for himself;
  • Communications with Florida businesses, media outlets, and communities regarding COVID-19 vaccines, social distancing, mask requirements, school and business closures;
  • Documents concerning vaccine efficacy and boosters, natural immunity, potential adverse events including myocarditis risks, messaging strategies, and communications with vaccine manufacturers.
