Trump Admin Uses GENIUS Move to Sidestep Judge Who Tried to Stop Them From Deporting Illegals


The Trump administration just pulled a brilliant move to get around a rogue, activist judge’s attempt to stop them from deporting certain illegal aliens.

Last month, U.S. District Court Judge Brian E. Murphy — who was appointed by Joe Biden — ordered the Trump administration to give illegal aliens with final removal orders a chance to argue if being deported could ‘jeopardize their safety.’

Keep in mind that several of these illegal aliens slated for deportation were Tren de Aragua gang members, and one was even a sex offender.

In other words, liberal Judge Murphy ordered the Trump administration to prioritize these criminals’ safety over that of American citizens.

However, the Trump administration went ahead and deported them anyways. And, in a hearing on Wednesday, DHS attorneys argued that they technically complied with Judge Murphy’s order.

You see, the Trump administration came up with a quick and creative workaround to deport these illegal gang members and sex offenders without violating the order.

They started deporting the illegals through the Department of Defense, instead of the Department of Homeland Security.

It also includes a sworn declaration from a DHS official, who stated that every person deported after Murphy’s court order was sent to Guantanamo Bay before being shipped off to El Salvador on military flights.

DHS has argued in a court filing that because DOD was not a defendant in the challenge to rapid deportations to third-party countries, deportations to El Salvador carried out by DOD did not violate Judge Murphy’s order requiring due process (notice and opportunities for protection applications).

Court records show three individuals were removed to El Salvador on March 31, 2025, by DOD on flights with no DHS personnel onboard.

The Trump administration argued Wednesday that it did not violate a federal judge’s restraining order detailing required due process for certain deportations to third-party countries because of a technicality.

Why it matters: Attorneys for the Department of Homeland Security (DHS) said that it had complied with Judge Brian E. Murphy’s order because the Department of Defense (DOD), rather than DHS, carried out the deportations in question.

Catch up quick: Plaintiffs in the case had challenged the Trump admin’s practice of deporting people to a country other than their own without giving them notice or a chance to contest their removal.

  • Murphy had previously told the Trump admin that people with final removal orders must have an opportunity to argue that deportation to a country other than their own could jeopardize their safety.
  • The Trump administration went ahead with several such deportations anyway.

    Last month, Murphy, an appointee of former President Joe Biden, sided with immigration lawyers who filed a class action lawsuit against the government on behalf of four migrants who they said were at risk of being deported without appropriate due process or had already been wrongly deported.

    Murphy responded by granting an order that did not stop the DHS from carrying out deportations but rather put a stipulation on removing any migrants who had received final orders of removal from an immigration judge. The order required the DHS to give “meaningful notice” to those migrants if the department planned to deport them to a country other than the one listed on their final orders of removal.

    When the immigration attorneys identified several foreign nationals who they said were deported without that level of notice, government attorneys responded that the Department of Defense had deported them rather than the DHS.

    One migrant was a registered sex offender in New York. Another migrant was an “identified Tren de Aragua (TdA) gang member” and was deported to El Salvador “by the Department of Defense on a flight with no DHS personnel onboard,” government attorneys said.

    “DHS did not direct the Department of Defense” to remove them, the attorneys said, adding, “The Department of Defense is not a defendant in this action.”
